BASIC TRANSACTION BREAKDOWN
The Seller options its "Steel" to the GSS Website.
Steel must be listed at 50% of the original cost.
The Seller must be the legal and beneficial owner of the property and be authorized to sell the equipment free of any titles or liens.
Before shipping the goods, a sales payment will be made in bank draft or approved credit to GSS Website
The Buyer will be responsible for the shipping costs of the equipment.
The Seller will be responsible for loading the equipment, without damage, onto a shipping truck or container.
All sales are subject to final inspection by the buyer.
The buyer will have 15 days to inspect the equipment.
If the transaction is confirmed by the buyer, GSS Website will render payment to the Seller within 15 days from the confirmation date.
Should any disputes arise from the Seller or the Buyer, decisions of GSS Website will resolve all matters, and the GSS Website's decisions are final.
Buyers Contract Agreement
Global Surplus Steel Inc. (GSS) reserves the right to refuse any buyer the privilege of buying, and may revoke such privilege at any time.
Sales payments will be made to GSS by bank draft or approved credit before shipment of goods. GSS will not disperse funds until buyer has received goods or 15 days after shipment. If goods are not as described in the Web Site, buyer must immediately notify GSS in writing of the discrepancy before the 15 day period expires. Consignor will then be responsible for all shipping and handling charges (to and from buyer) and will pay these charges to GSS before return of any property. GSS will then reimburse the buyer for their costs of shipment. If no funds are received within 15 days, GSS reserves the right to liquidate the goods and refund the buyers shipping costs.
Payment by way of Visa or MasterCard will be accepted for purchases whose total invoice does not exceed $2,500.00. An administration fee may apply , subject to GSS discretion.
All applicable HST, GST or provincial sales taxes will be charged on all sales and be paid to GSS at time of sales.
Should any dispute arise between two or more buyers on the web site, the decisions of GSS shall regulate all matters and the decision shall be final and binding on all buyers.
GSS reserves the right to sell and buy for its own account and for the account of others and may sell or remove items from the Web Site at its discretion. GSS shall have no liability to any person or Company whosoever, including without limitation, any damages for loss of profits.
All sales are subject to final inspection by the buyer. Inspection to be within 15 days of shipping from seller. Title to purchases shall not pass until 15 days after payment in full of the purchase price is received by GSS and purchaser has accepted goods.
All sales are on an 'AS IS', 'IN PLACE' with all faults basis. There are no conditions or warranties whether expressed, implied, statutory or otherwise, including without limitation, warranties or conditions as to title, description, fitness for purpose, quantity, quality, merchantability, state, condition or otherwise.
The purchaser shall be responsible for all costs of shipping.
No purchaser may assign, transfer or dispose of their rights in any article purchased before they have paid the purchase price in full. Notwithstanding, these terms and conditions shall continue to be in effect and automatically transferred to any assignee or transferee.
GSS assumes no responsibility or any liability once title passes, which occurs as per item 7. Without limiting the generality of the foregoing, GSS shall not be liable for any insurable risk, including but not limited to fire, or theft.
Time shall be of the essence. Title may revert to seller in the event purchaser does not arrange and effect shipping by 5 days after purchase.
Sellers Contract Agreement
Consignor warrants to Global Surplus Steel Inc. (GSS) and to the buyer that the Consignor is the legal and beneficial owner of the property listed on schedule A or is properly authorized to sell the property by the legal and beneficial owner and is able to transfer good and marketable title to the property free and clear of any liens, claims or encumbrances from any party and is not subject to the collection of any excise tax, Custom Duty or any other taxes or duties for any reason whatsoever. GSS acts as an agent only.
The Consignor will indemnify and save harmless GSS against any threatened or actual legal suits, actions, costs or charges, whatsoever, in respect to any liens, charges or encumbrances or defects in title on or to the property.
A sales commission of 50% on the gross sale price of the property will be charged to the Consignor, deducted from gross proceeds and retained by GSS. Consignor is responsible for the accurate description of the goods. Consignor is responsible for the loading of the goods onto a truck.

A sales price will be placed upon the property by the consignor. This amount will be established in writing (description of form) prior to the consignment of goods.
Changes to the amount of an already established sales price must be in writing by the consignor and approved by GSS. While GSS may accept verbal instructions, GSS will not be held responsible for errors should a price be entered into our records incorrectly.
Risk of action including rights of ownership of the property remains with the consignor at all times. Consignor is solely responsible for maintaining insurance coverage on the property at all times. All rights of subrogation by consignor or its insurer against GSS are hereby waived.
No property may be withdrawn from the sales process if there is an existing offer to buy the goods. Property may be withdrawn when there is no offer to buy and the withdrawal must be writing to GSS. If goods are withdrawn and there is an existing offer to buy, GSS will be entitled to the commission described in article number 3.
Transportation costs will be the responsibility of the Buyer.
Payment for goods will be approximately 25 business days after sales date.
